These General Terms and Conditions (GTC) apply to all business relationships between the Golf Performance Institute (hereinafter referred to as "GPI") and its customers. By placing an order, the customer agrees to these GTC. Deviating terms and conditions of the customer are not recognized unless GPI expressly agrees to their validity in writing.
A contract is concluded as soon as the customer places an order in writing, by e-mail, by telephone or in person and this is confirmed by GPI. The customer receives a confirmation of the order with all relevant information. The customer is obliged to check the order confirmation immediately for correctness and to report any errors without delay.
3.1 All custom-made golf clubs, as well as modifications to existing clubs, are manufactured according to the customer’s specific requirements. This includes the selection of the clubhead, shaft, grip, and other components based on the results of the fitting.
3.2 Since these are custom-made products, all commissioned golf club orders, as well as workshop and repair services, are excluded from cancellation or return, unless there is a verifiable defect attributable to an error on the part of GPI.
4.1 The prices listed include the applicable value-added tax, unless otherwise indicated.
4.2 The invoice amount is due immediately upon receipt of the invoice, without any deductions, unless otherwise agreed.
4.3 GPI reserves the right to require a down payment for custom-made items. The exact amount and payment terms will be agreed upon in writing in advance.
5.1 Since the custom-made golf clubs and workshop and repair services commissioned by GPI are custom-made products tailored to the customer’s specifications, cancellation is not permitted once the order has been placed. The customer expressly agrees to waive any statutory right of withdrawal pursuant to Section 312g(2)(1) of the German Civil Code (BGB).
5.2 If , due to special circumstances (e.g., supply shortages, unforeseen material issues), GPI is unable to provide the contracted service, the customer will be notified immediately. In this case, the customer has the right to cancel the contract, and any payments already made will be refunded in full.
6.1 GPI will provide the agreed-upon services within the agreed-upon timeframes, unless otherwise agreed.
6.2 In the event of delays beyond GPI’s control (e.g., delivery problems with suppliers), the agreed-upon deadlines shall be extended accordingly. In such cases, the customer will be notified immediately.
7.1 Liability under the Product Liability Act remains unaffected. Any further liability is excluded, unless mandatory statutory provisions provide otherwise. GPI guarantees the proper performance of the contracted services as well as the use of high-quality materials in accordance with the contractual agreements.
7.2 In the event of defects, the customer is obligated to notify GPI in writing immediately, but no later than within a reasonable period after their discovery. GPI has the right, at its discretion, either to remedy the defect (repair) or to provide a replacement. The customer’s statutory warranty rights remain unaffected, unless expressly provided otherwise below.
7.3 GPI shall be fully liable:
for damages resulting from injury to life, body or health which are based on an intentional or negligent breach of duty by GPI, its legal representatives or vicarious agents;
in the event of intent and gross negligence;
in the event of a breach of material contractual obligations (cardinal obligations), even in the event of slight negligence, but limited to the foreseeable damage typical of the contract.
7.4 Liability under the Product Liability Act remains unaffected. Any further liability is excluded, unless mandatory statutory provisions provide otherwise.
7.5 Disclaimer Regarding Workshop and Repair Services
In the case of workshop and repair services (including the adjustment of loft and lie for golf clubs), GPI points out that this work may entail an increased risk of damage, functional limitations or visual changes due to the nature of the material and the individual use of the product.
Own risk: Such services are performed at the express request of the customer and at the customer's own risk. GPI assumes no liability for damages or consequential damages resulting from these services, unless these are due to intentional or grossly negligent behavior on the part of GPI, its legal representatives or vicarious agents.
Excluded in particular are
Damage caused by material fatigue, pre-existing defects or non-visible defects in the material;
Functional restrictions or visual impairments caused by necessary interventions.
Customer's declaration: The customer expressly agrees to this exclusion of liability before the workshop or repair service is carried out.
7.6 Additional Information:
Liability for injury to life, body, or health, as well as liability under the Product Liability Act, remains unaffected.
The delivered products remain the property of GPI until the agreed price has been paid in full.
All data collected in the course of placing an order will be treated confidentially and used exclusively for processing the order. Further information on data protection can be found in GPI's separate privacy policy.
10.1 Validity Period:
All vouchers issued by GPI (gift certificates, fitting vouchers, training vouchers, and indoor simulator vouchers) are valid for 12 months from the date of purchase. After this period expires, the vouchers are no longer valid. An extension is possible only at the discretion of the Golf Performance Institute (GPI).
10.2. Personalization and Transferability:
The gift certificates are issued individually in the name of the recipient and are not transferable to third parties. Personalization is based on the information provided by the purchaser at the time of purchase. Changes to the name or subsequent transfer to other individuals are not permitted.
10.3 Redemption:
Gift certificates may be redeemed exclusively for the services and offers listed on the gift certificate. The value of the gift certificate cannot be redeemed for cash.
10.4 Loss of the Gift Certificate:
Gift certificates may be redeemed exclusively for the services and offers listed on the gift certificate. The value of the gift certificate cannot be redeemed for cash.
11.1 The laws of the Federal Republic of Germany shall apply , excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
11.2 The place of performance and venue shall be GPI’s registered office, provided that the customer is a merchant, a legal entity under public law, or a special fund under public law.
11.3 If any provision of these General Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that most closely approximates the economic purpose of the invalid provision.
